"Whenever the President shall proclaim an emergency to exist the Secretary of Labor shall take into custody all aliens subsisting upon public or private relief and deport them forthwith to the country of their origin." It is not a matter of committing a crime. it is a matter of being here and of our deporting them. This would give the right to deport the father and mother. but I raise the question as to whether we could do that when the consequences would be to deport a child born in the United States. in the face of the fifth and the fourteenth amendments.
