We recognize no basic moral right on the part of subjects of any foreign government. who owe and profess no allegiance to our own. to representation either in our national lawmaking body or in the selection of our President and Vice President. The fact that they are not allowed to vote does not alter the situation. Their numbers increase the congressional representation of the States in which they reside. giving them a power disproportionate to the numbers of their citizens. to the disadvantage of States whose alien population is small. and congested as they usually are in certain restricted areas. such as what is known as " Little Italy " in New York City. they furnish the population basis upon which their naturalized countrymen. residing in the same area. and actuated by the same ideas and beliefs. are permitted to elect Congressmen and select electors for the election of a President. The injustice extends further than the disproportionate power between the States. it causes the setting up within the States of congressional districts based on alien population. where fardifferent district lines would be necessary if only citizens were counted. and subjects American citizens living within those areas to the domination of foreign elements. It is unfortunate that the question cannot be discussed intelligently without referring to particular States and localities within States.
