Tennessee. and to a modified extent California. have similar provisions excluding aliens in apportionment for the State legislature. Why should there be one rule as to the people who may be counted for the purposes of apportionments in the States and another for the Nation? The claim has been made that. if our country continues to pursue a restrictive immigration policy. the alien matter will in the course of time be adjusted. This will not be true because there are many in the United States who are ineligible to citizenship and their children are and will be under the same disability. If the principle contended for is just and right. it is immaterial whether there be a few or millions of aliens in this country counted In congressional apportionments.
