On the same day. Mr. Stevens also introduced the following Joint resolution which was referred to the Committee on the Judiciary: Representatives shall be apportioned among the several States which may be within the Union. according to their respective legal voters. and for this purpose. none shall be named legal voters who were not either naturalborn citizens or naturalized foreigners. On January 16. 1866. the chairman of the subcommittee on the basis of Representatives. reported to the joint committee on reconstruction that it had adopted the following article: Representation and direct taxes shall be apportioned among the several States which may be Included in this Union. according to their respective numbers. counting the whole number of citizens of the United States and in each State : Provided. That when the elective franchise shall be denied or abridged In each State. on account of race. creed. or color. all persons of such race. creed. or color shall be excluded on the basis of representation.
