Sure. always. Gentlemen you will find a statement in some of these hearings to the effect that these immigration authorities have not any money with which to go and look for anybody except those that are practically delivered to them for the purpose of deportation. The public is led to believe that some real effort is being made to run down and deport vicious and criminal aliens. in addition to those that are shoved out of the penitentiaries for the purpose of being deported. and that sailors and other "sneakins" are located and sent away. but not so to any extent. Why? No funds. And further. Mr. Chairman. even the arbitrary deportation of aliens who step out of prison may go to pieces if other governors follow the precedent of Governor Smith. of New York. who has decidedor his legal adviser for himthat a man paroled from the penitentiaries of that State shall not be held for the Immigration Service to take into custody and deport. but that it is up to the Immigration Service to go and find the paroled man when his parole runs outand that costs money. Also Governor Smithor his legal adviserhas stated to the Labor Department that if the department can not see that phase of the conflict between Nation and State it may become necessary for Governor Smith to issue pardons to those convicted deportable alien criminals coming out of the New York penal institutionsto pardon them to prevent their being deported by the Federal Government. That is one interesting phase that is developing in connection with deportation. It shows the power of alien influence. by the way.
