Chairman and gentlemen. this bill. if enacted in the form in which it is reported would delegate to. the States the right and power of determining what aliens should be allowed to remain within their borders. because section (c) provides that if any alien is convicted of the violation of any State statute prohibiting ox regulating the manufactue. sale. transportation. importation. or exportation of intoxicating liquors for beverage purposes. or of dplim. and so. forth. then the Secretary of Labor. under the mandatory provision of section 19 of the socalled Durnett Act. would be compelled to deport him. The gentleman reporting this bill glosses over the main objections and tries to represent to this House that a perso.n can be deported- only after the violation of either the national prohibition enforcement act or a State prohibition act on successive occasions. I deny it. I claim that if any person is convicted of a violation of either the national prohibition act or any State prohibition act. convicted of one offense. then it is the duty of the Secretary of Labor to deport him immediately under the provisions of section 19 of the Burnett Act.
