I do not think that was the holding. I know the gentleman .referred :to that when this matter was before the House on aprevious occasion. but I am informedalthough I am frank to.say I .have not looked up the decisionthat the holding does not fully bear out the gentlemans contention. I know what the holding of the SupremeCourt .of the United States was in the naturalization case. where the arguments were on all four� with the question before the House. The holding In that .case was that where the Constitution granted to Congress the power to pass exclusive legislation. until Congress did pass that exclusive legislation the State could pass legislation to take care of existing situations. That Is what the State of New York has done in relation to this water -power. and the 15.600 cubic feet that are .now being taken are being taken by authority of law.
