Mr. Chairman. this proviso reads: Provided. That. for the purposes of this act. the marriage to an American citizen of a female of the sexually immoral classes the exclusion or deportation of which Is prescribed by this act shall not invest such female with United States citizenship. I am quite in sympathy with the purposes of the proviso. but I do not understand how you can declare a person an American citizen for one purpose. and then declare that such person is not an American citizen for another purpose. The Constitution of the United States provides thatThe Congress shall have power * * * to establish an uniform rule of naturalizationAnd then provides further thatAll persons born or naturalized in the United States. and subject to the jurisdiction thereof. are citizens of the United States. And there is no power in Congress to declare that a person is a citizen of the United States. but shall not be considered a citizen under some special provision of law. When one becomes a citizen of the United States. the United States under this law can not deport that person.
