Judge Clayton ruled one way mind Judge Townsend ruled another. the first that the Mississippi Choctaws must move to have right and the second that they needi not. There were two judges of the Federal court out there. and the Supreme Court never did afirm the decision of Judge Clnyton. What the Supreme Court said was. "Congress has vested in these Federal courts in the Indian Territory final jurisdlction upon this subject." and that itthe Supreme Courthad no jurisdiction to consider an appeal upon the merits. and therefore the case was disiiissed. just as when you go to the Sulprme Court from a decision of the Immigration Bureau deporting a Chinaman. the Surwelle Court has said "We have no jurisdiction upon this question." Congress has erecied an administrative and judicial tribunal having final jurisdiction. There is a case. Senatorsand. by the way. it ought to interest us for another reason. because we do not want tyranny in the United Stateswhere a Chhuinan was born in the United States. and left and went to China and came back and was arrested and ordered to be deperted.
