The United States was unable to discharge that obligation when the war came on. but. nevertheless. when that war was over the United States. recognizing its previous treaty obligations. in 1860 entered Into a nev.treaty with them containing the provision in article 4. as follows: Immediately after the ratification of this treaty the United States agree to ascertain the amount due the respective soldiers who enlisted In the Federal Army. loyal refugee Indians and freedmen. in proportion to their several losses. and to pay the amount awarded each in the following manner-
