P. 13500) to amend an act entitled "An act to regulate the immigration of aliens into the United States." approved February 20. lie it enacted. etc.. That section 2 of the act entitled "An act to regulate the immigration of aliens into the United States." approved February 20. 1907. is hereby amended so as to read as follows: " SEc2. That the following classes of aliens shall le excluded from admission into the United States : All Asiatic laborers . all idiots. imbecues. feebleminded persons. epileptics. insane persons. and persons who have been insane within five years previous. persons who have had two or nmre attacks of insanity at any time previously . paupers . persons likely to become a public charge . professional beggars . persons afilicted with tuberculosis or with a loathsome or dangerous disease. persons not comprehended within any of the foregoing excluded classes who are found to be and are certified by the examining surgeon as being mentally or physically defective. such mental or physical defect being of a nature which may affect the ability of such alien to earn a living. persons who have betn convicted of or admit having committed a felony or other crime or misdemeanor involving moral turpitude. polygamists. or persons who admit their belief in the practice of polygamy. anarchists. or persons who believe in or advocate the overthrow by force or violence of the Government of the United States. or of all government. or all forms of law. or of the assassination of public officials. prostitutes. or women or girls coming into the United States for the purpose of prostitution or for any other immoral purpose. persons who are supported by or receive in whole or in part the proceeds of prostitution . persons who procure or attempt to bring in prostitutes or women or girls for the purpose of prostitution or for any other immoral purpose. persons hereinafter called contract laborers who have been induced or solicited to migrate to this country by offers or promises of employment or in consequence of agreements. oral. written. or printed. expressed or implied. to perform labor in t ils country of any kind. skilled or unskilled: those who have been. within one year from the date of application for admission to the United States. deported as having been Iwcv!ed or solicited to migrate as above described. any person whose ticket or passage Is paid for with the money of another. or who Is assisted by others to come. unless it is affirmatively and satisfactorily shown that such person does not belong to one of the foregoing excluded classes. and that said ticket or passage was not paid for ty any corporation. association. society. municipality. or foreign government. either directly or indirectly. fll children under 10 years of age unaccompanied )y one or both parents. at the discretion of the Secretary of Commerce and Labor or under such regulations as lie may from time to time prescribe : Provided. That the provisions of this law alpplicable to contract labor shall not be held to exclude professional actors. artists. lecturers. singers. ministers of any religious denomination. professors for colleges or seminaries. persons beomging to any recognized learned profession. or plersous employed strictty as personal or domestic servants." fine. 2. That the provisions of said additional sections shall be regarded as supplemental to the general provisions of the act hereby amended. which general provisions shall also be cuforced against Asiatt aliens to the same extent and in the same manner is against other aliens: S.e. 45. That it shall le the duty of all Asiatic laborers to apply to such officers of the United States us may be designated In their respective districts for tlhat purpose by the Commissioner General of Immigration and Naturalization. with the approval of the Secretary of the Department of Commerce and Labor. within one year after the passage of this act. for a certificate of residence: and nny Asiatic laborer who. after the expiration of said year. shfall be found within the United States without such certificate of residence shall be deemed to be unlawfully within the United States and shall be taken into custody upon the warrant of the Secretary of Commerce and Labor. wihenever and wvherever found and unless it shall be satisfactorily established that the failure of such person to procure a certificate of residence as herein provided was by reason of accident. sickness. or other unavoidable cause. shall be deported upon the warrant of the Secretary of Commerce and Labor to the country of which he is a citizen or subject. at the expense of the United States. " Should it appear that said Asiatic laborer had procured a certificate and suchi certificate had been lost or destroyed. he may be granted a duplicate thereof under such conditions as tme Secretary of Commerce and Labor may prescribe. aind upon receipt of such duplicate lie may be discharged : Providecd. That no Asiatic laborer who has been convicted in any court of the States. Territories. or insular possessions of the United States. or of the District of Columbia. of a felony. and has not been pardoned therefor by legal authority. shall be permitted to register inder the provisions of this act. persons of Asiatic descent who claim birth in the United States may also be registered under the provisions hereof on satisfactorily proving such claim. and such persons hereafter born in the United States may likewise be rfgistered. " Certificates of residence Issued under the provisions of this act shall tie so prepared under regulations of the Secretary of Commerce and Labor as to prevent counterfeiting. and shall contain such descriptions of the persons to whom issued as will readily identify the holders thereof. Including photographs of such holders. both full face and profile. tipo a portion of which photographs sbiali be superimposed the seal of the Department of Commerce and Labor. also a print in indelible ink of the front part of each thumb. commonly known as a thumb print. SEC. 40. That no certificate of residence other than a duplicate of one satisfactorily proved to have been lost or destroyed shall be issued under the provisions of this act after the expiration of one year front the date of the taking effect of this act. unless It is established in accordance with the provisions of section 45 hereof that the failure to secure the certificate within the time" specif d was due to accident. sickness. or other unavoidable cause. If the alien applying for the certificate is a merchant. said certificate shall. in addition. state the nature. character. and estimated value of time business carried on by him prior to fnd at the time of his application therefor.
