In the administration of the pension laws it is necessary to determine whether the applicant for a pension has made the proof that the law requires. whether his status is such that the law will authorize the granting to him of a pension. The duty of settling these questions is an essential part of the administration of the law and logically belongs to the administrative officers. The immigration law likewise devolves upon the immigration officers the duty of deciding whether an applicant who applies at one of our ports for admission to the United States has complied with the law upon the subject. and the courts have universally held that when Congress has authorized Department officers to decide such questions. although they partake of the nature of a judicial power. the decision of the officer upon all questions of fact is final. Those questions are classed among administrative powers as a matter of necessity. for if they had to be determined in the courts the delay would greatly embarrass the proper administration of the great activities of the Government.
