Mr. Chairman. in my opinion it does not. The head tax. while it is called a head tax. is imposed. not under the taxing power granted by the Constitution. but under the right given us by the Constitution to control immigration. Moreover. while it might be very true that we could not impose on our own citizens a differential tax. if they arrive in Hawali. from the tax -imposed upon them if they arrive in New York. I think. without question. it is competent for us to impose such a differential tax on an alien. Mr. Chairman. we have heard a great deal about bigotry being at the bottom of this movement.
