It was made with that legislation in view. Nothing in the existing law can be said td be in violation of the treaty. because the treaty was made subsequent to all those acts. and therefore recognized those acts. except of course if there should be any case where it distinctly overrode them. I wish to call attention to the statement of its intention. found in the beginning of the treaty of 1894: And whereas the Government of China. in view of the antagonism and much deprecated and serious disorders to which the presence of Chinese laborers has given rise in certain parts of the United States. desires to prohibit the emigration of such laborers from China to the United States. And whereas the two Governments desire to cooperate in prohibiting such emigration. In other words. the Chinese Government binds itself as the intent of that treaty to prohibit and to cooperate with us in prohibiting the entrance of Chinese laborers into this country. They express that intention and desire in view of the legislation of the United States then existing on the statute book.
