I will state to the gentleman that this man came to this country when he was 13 years old and served in the Mormon and civil wars. and thought he took out naturalization papers in New Orleans. It was ascertained that no record could be found of them. Subsequently he was depredated on by some Indians and. as I understand. the Government does not have to pay it. but it comes out of the Indian fund. He brought suit in the United States court to recover it. and that act has been construed to apply only to citizens of the United States. and he not having been naturalized is thereby barred from bringing suit.
