United States called the Competitor. has been. captured by a Spanish ship f war. and that one or more citizens of the United States were capturedon board said vessel. and have been tried and condemned.to death by a.military. tribunal.in Cuba. and arenow in prison at Habana awaiting the execution. of the sentence. And the Senate having instructed said committee to inquire into and make report respecting the rights of said citizens. under the. treaties existing between ithe United States and Spain and under the laws of nation". the President is requested. in conformityth .section 2001 of the Revised Statutes. to inform the Senate whether any suchcapture has .been made.by a Spanish war ship. and whether any citizen of the United States bashbeen captured on or near such vessel. and "hasbeen unjustly deprived of his libery by or under the authority of." the Government of Spam. and. whether the President forthwith demanded of Spain the reaons of such imprisonment. and. if such imprisonment is unlawful. and if such sentence to death violates the laws of nations. or the treaties with Spain.whether. the President has demanded the release of such citizens. And that the President communicate to the Senate all the facts andkproceding d r oltive to nch capture f sentence. and imprisonment o f su achctizens. as soon as practicable. in accordance with the statute in such casesmade ane provided. as follows:. "Sec. 2dO All naturalized citizens of the United States. whileein foreign countries. are entitled to and shall receive from the Government the same protection of persons and property which is accorded to nativebornucitizens. "Sac. 0e1" Wheneverit is made known to the Presldent thatany citizen of the Uited Stateshas been unjustly deprived of. his liberty. by. or under the authority of any foregngovernment. it shall be the duty of. the.President forthwith to demandof that government the reasons of such imprisonment. and if. it .appear to he wrongful and in violation of the rights of:A erican citizenship. the President shall forthwith demand the release ofisuch tcitiaen. and if the release so demanded is unreasonably delayed or refused. the Presidnt shalluse such means. not amounting to acts of war. as he may think necessary and prope. to obtain or. effectuate the release. and all the facts andproceedings relative thereto shall. as soon as practieable. becommuniatsdiby the President to Congress."
