Another matter addressed by the amendment involves the codification of employment standards that are at least "comparable to those under the current regulations." While I appreciate the intent to clarify the language that is presently in the Education and Labor Committee bill. the amendment to be presented following by the gentleman from California . I must at the same time emphasize that the language in this amendment is flawed for similar reasons. This ties the hands of the Secretary of Labor regardless of the situation that may arise under an H2 program that may take on a different character as the Western United States goes through the transition of an undue reliance on undocumented labor to domestic and H2 temporary foreign workers. We might like to say that we can close off the border completely and we will not have those workers. But if you look at least since 1880. we have had temporary workers.
