Mr. President. it is not only true. as stated by the chairman of the committee. but we might go farther and state the fact as disclosed by this section. that this is a penalty imposed upon the Chinaman who is found here without a certificate at that time. not merely for violating the laws in beinghere. but for violating the provisions of this very section. This section defines an offense a crime and imposes the penalty in and of itself irrespective of any existing legislation on the subject of Chinese immigration. It providesThat any Chinese person subject to enumeration on the I st day of June. 1890. who shall fail or refuse to give the information required by the census enumerators at the time of taking the census in June. when so called upon. or who shall fail or refuse. for the period of ninety days from said 1st day of June. to comply with the provisions of this actShall be deemed unlawfully here. That is an offense. a misdemeanor defined by this section.
