If that be so. of course the votes are illegal. I do not think there is any State or any Territory anywhere in the Union that has ever given the franchise to aliens. But I find the objection really applies. although "aliens" was used and used repeatedly in discussing it. to a class of persons who have taken out what are called first papers in naturalization. It was said they were not entitled to vote because. although they had taken out first papers. they had not taken an additional oath to support the Constitution of the United States and because they had not taken out their first papers in open court or at the clerks office. Now. with respect to the place where this declaration should be made. whether it ought to be made in the clerks office or in open court.
