I have the honor to report that in my opinion the loyalty of the claimant is fully established. and that he is justly entitled to a part. if not the whole. of the claim. but there is no appropriation out of which be can be paid by tho Department. "Goyaux died November 20. 1871. He was a native of France. and it appears that his widow and children did not know that he had ever become a citizen of the United States. The widow and children Of Goyaux caused the claim to be presented to the French and American Claims Commission but upon investigation it was discovered that Goyauz had become a naturalized citizen of the United States in 1857. and consequently. he being an American citizen. the French and American Claims Commission could not adjudicate the claim. "The claim was cognizable before the Southern Claims Commission. but Goyaux dled a few months after this commission was established. and it is satisfactorily shown that his legal representatives had no knowledge whatever that the claim could be considered by the Southern Claims Commission until long after that commission expired by limitation of law. "The original claimant. Goyaux. was diligent in asserting his claim. "We are satisfled that the property hereinbefore described was taken pursuant to the order of Colonel Paine. the commanding officer. that it was adapted to the use of the Army. and that it was actually used by the Army. We are also satisfied that itwas of the value of 51.545. "We therefore report back said bill and recommend that it do pass."
