There is no analogy between this provision. which is purely a prohibition on the States. and those positive grants of power upon the Government of the United States itself. Prohibitions are to be found in many of the provisions of the ConstitutionI was going to say perhaps in a majority of the clauses of that instrumentprohibitions on the States as well as on the United States. The whole of sections 9 and 10 consist of prohibitions. prohibitions with respect to the emigration and importation of certain persons. with respect to habeas corpus. bills of attainder. ex post facto laws. capitations and other direct taxes. regulations of commerce. appropriation of money. titles of nobility. &c. And every one of the ten amendments first made to the Constitution is a prohibition upon the Government of the United States and limitation upon its powers. Nor can I find in the history of the Government any legislation with respect to these prohibitions which have carried the jurisdiction of the United States further than the limits I have described.
