The act of Congress which is s) assailed by the Executive. secured expressly to every Chinaman in this country at the time of the passage of the act. and to those who should come within sixty days thereafter. all the privileges and immunities unimpaired as given by the Burlingame treaty. If there was any increase by birth among those already here there was to be no interference with such offspring. I therefore say. that so far from the interpretation given to the treaty by the American Congress. that twenty years was a reasonable limitation being assailable. it was far less restrictive of emigration in its results than the proposition made by the Chinese commissioners themselves. which aas. that under no circumstances should ithe total number of their people then in this country be ever increased beyond what it was at the date of the treaty. But further as to the power of regulation conceded to the Government of the United States. I read again from the Chinese coatmissioners reply: As to limitation in time they meant. for example. that Chinese should be allowed to go in altercate years. or every thid year. or. for example. that they should not be allowed to go for two. three. or five yers.
