President. the first article of the treaty between the United States and China. concluded November 17. 1880. proclaimed October 5. 1881. is in the following language: Whenever in the opinion of the Government of the United States the coming of Chinese laborers to the United States. or their residence therein tffects. or threatens to affect the interests of that country. or to endanger the good order of the said country or of any locality within the territory thereof the Government of China agrees that the Coverument of the United States may regulate. limit. or anpontd sach coneing or residence. but may not absolutely prohibit it. The limitation or suspensio shall be reasonable. and shall apply only toChinese who iay go to the United States as laborers. other classes not bei included in the limitations. Legislation taken in regard to Chinese laborers wi be of such a character only as is necessary to enforce the regulation. limitation. or suspension of such immigration. and unmigrants shall not be subject to personal maltaeatment or abuse. I read this for the purpose of saying that whatever doubts m.iy exist as to the policy of this proposed legislation. there cannot be any doubt whatever as to the right of Congress to enact it. That has passed beyond the domain of legitimate discussion.
