There is nothiig its the Coisftitution which will justifyin my judgment such a conclusion. The Constitution is the presentation in an orderly and compact form of the great principles underlying civil and religious liberty which induced the settlement of the colonies. and which great principles. growing with the growth and strengthening with the strength of the colonies. were formulated in the Constitution of the United States. A careful examination of that instrmnent in view of the surrounding circumstances at that time. in my judgment. establishes the fact that the only people ever dreamed of to be naturalized citizens of the United States by the framers of the Constitution or by the people of the States which ratified it were people of the Caucasian race. The Constitution of the United States. in the eighth section. grants to Congress the power to establish auniform rule of naturalization. and in the ninth section it declares thatThe migration or importation of such persons as any of the States now existing alti think proper to admit. shall not be prohibited by the Congress prior to the year 1808. but a. tax or ditty may he imposed on such importation. not exceeding $10 for each persen. Thes it will be seen that the framers of the Constitution drew a distinction between those who were to be naturalized and those who might be imported. In view of the surroundings. in view of the condition of things at the time of the adoption of the Constitution. we must construe it. What class of people came here at the time the Constitution was adopted and claimed citizenship in ttis country ?
