That section 2403 of the Revised Statutes of the United States Ue. al is hereby. amended so as to read as follows: SEC. 2403. Where settlers male deposits in accordance with the provisions of section 2401. the amount so deposited shall go in part payment for their lands situated in the townships the surveying of which is paid for out of such deposits. or the rertiflrates issued for such deposits may be assigned by indorsement. and he received in payment for any pablic lands of the United States entered by settlers tnder the preemption and homestead laws of the United States. and not otherwise. The substitute was to strike out all after the enacting clause and to insert in lieu thereof the following: That the act entitled "An act to amend the act entitled An act to encourage the Erowth of timber on western prairies." approvedMarch 13.1874. be. and the same is hereby. amended no as to read as follows: That any person who is the head of a family. or who has arrived at the ae of twentyone years. and is a citizen of the United States. or who shall have file3 his declaration of intention to become such. as required by the naturalization laws of the United States. who shall plant. protect. snd keep in a healthy. growing Ondition for eight ears ten acres of timber. the trees thereon not beig more than four feet apart each way. on any quarter section of any of the public lands of the United States. or five acres on any legal subdivision of eighty acres. or two and onehalf acres on any legal subdivision of forty acres. or onseighth part of any fractional subdivisionof land less than forty acres. shall be entitled toapatent for the whole of said quarter section. or of such legal subdivision of eighty or forty acres. orfractional subdivision of less than forty acres. as the ease may be. at the expiration of said eight years. on making proof of such fact by not less than two credible wit. ncsses. ndil a full compliance of the further conditions as provided in section 2: .Frided further.
