Suppose a man be elected to this House. who is declared ineligible by the Constitution. he is an alien for instance. he receives the certificate. he comes here and takes the oath. a bill is brought before the House. the vote is even except for his vote. he votes for the bill and it is passed and it becomes a law . will the lawyers of this House tell me that that law is void because it was subsequently ascertained that this man was ineligible. Suppose that he votes for a Speaker and his vote elects.will itTe said that a Speaker has not been elected ? Take the case of those States where the judiciary is elected. Aman not naturalized but a resident is chosen to the office of judge. Ite qualities. so far as his oath can qualify him. and he goes onfor ayear discharging the duties of a judge. A thousand cases pass under his jurisdiction and his decisions go upon the record.
