May we not hope that after nearly a decade has separated us from the termination of the war the same candor can be invoked in the consideration of the present subject of discussion 7 If so. then the dawn of a happier dayof peace. prosperity. and a genuine reunionis surely breaking upon the Ameican people. The power to pass this law it is asserted is to be found in the first section of the fourteenth article of amenuents to the Constitution of the United States. That section declares: All persons born or naturalized in the United States. and suhject to the jurisdic tien thereof. are citizens of the United States and of the State wherein they. reside. No State shall make or enforce any law whichoahall abridge the privileges or nimldties of citizens of the United States: nor shall any State deprive any person of life. liberty. or property without due process of law. nor deny to any person within itsjurfsdietion the equal protection of the laws. Then follow the third. fourth. and last section. which provides Congress shall have power to enforce by appropriate legislation the provisions of the article.
